    Introduction

    These Terms of Service ("ToS") govern the use of our services, including graphic design, web design, animation, and 3D rendering. By using our services, you agree to be bound by these ToS.

    2. Definitions

    • "We" or "us" refers to Fox Arteffects trading as Mzansi Pixelab, a Private Company(Pty Ltd) registered in South Africa.
    • "You" or "client" refers to the individual or entity using our services.
    • "Services" refers to the graphic design, web design, animation, and 3D rendering services we provide.

    3. Scope of Work

    We will provide the services as outlined in our proposal or agreement. You agree to provide us with all necessary information, materials, and feedback to complete the project.

    4. Quotations and Acceptance

    • All quotations provided by Mzansi Pixelab are valid for a period of 30 days.
    • Acceptance of a quotation and these TOSs constitutes a binding agreement between you and Mzansi Pixelab.
    • Any changes to the scope of work or additional services will require a new quotation or cost estimate.

    5. Fees and Payment Terms

    • A non-refundable deposit of 30% is required to commence work on any project. The remaining balance is due upon project completion.
    • For projects requiring ongoing work, such as retainer agreements, payments are due monthly, on or before the 26th of each calendar month.
    • Payment is due upon receipt of invoice.
    • We accept EFT bank transfer.
    • Late payment fees may apply.

    6. Revisions and Changes

    • Each project includes up to two (2) rounds of revisions. Additional revisions will be charged at an hourly rate.
    • Significant changes that fall outside the original scope of work will require a new agreement and may incur additional fees.

    7. Client Responsibilities

    • You are responsible for providing all required content, images, and feedback in a timely manner. Delays in providing materials may result in project timeline extensions and additional fees.
    • You must ensure that any content or images provided to Mzansi Pixelab have the necessary permissions and rights for use. You agree to indemnify Mzansi Pixelab against any claims relating to the unauthorized use of third-party content.

    8. Ownership and Intellectual Property

    • We retain ownership of all intellectual property rights in our work, including designs, concepts, and ideas.
    • Upon full payment, we grant you a non-exclusive license to use the final deliverables for your intended purpose.
    • Mzansi Pixelab retains the right to use completed work in its portfolio and for promotional purposes unless otherwise agreed upon in writing.

    9. Cancellation and Refund Policy

    • If you cancel a project after it has commenced, the deposit is non-refundable. You will be billed for any work completed up to the point of cancellation.
    • In the event Mzansi Pixelab cancels the project, you will receive a full refund of any deposit paid.

    10. Force Majeure

    Mzansi Pixelab shall not be liable for any failure or delay in performing services where such failure or delay is due to causes beyond our reasonable control, including but not limited to natural disasters, war, or government actions.

    11. Confidentiality

    We will keep confidential all information and materials provided by you.

    12. Warranties and Representations

    We warrant that our services will be performed with reasonable care and skill. However, we do not warrant that our services will be error-free or meet your expectations.

    13. Limitation of Liability

    Our liability for damages or losses arising from our services is limited to 10%.

    14. Termination

    Either party may terminate this agreement upon 30 days' written notice.

    15. Governing Law

    These ToS will be governed by and construed in accordance with the laws of South Africa.

    16. Dispute Resolution

    Any disputes arising from these ToS will be resolved through Negotiation.

    17. Changes to ToS

    We reserve the right to update these ToS at any time. Changes will be effective immediately upon posting on our website.

    By using our services, you acknowledge that you have read, understood, and agree to be bound by these ToS.

    Refund Policy

    1. Introduction

    We want to ensure that you're satisfied with our services. If for any reason you're not satisfied, we offer a refund policy as outlined below.

    2. Eligibility for Refund

    To be eligible for a refund, you must:

    • Have purchased our services within the last 30 days
    • Have not received the services or products as described
    • Have not approved or signed off on the final deliverables

    The refund amount will be:

    • 100% of the deposit or payment made for services not received or products not delivered
    • 50% of the deposit or payment made for services partially received or products partially delivered

    5. Exceptions

    The following are exceptions to our refund policy:

    • Custom or bespoke services or products that have been partially or fully completed
    • Services or products that have been approved or signed off on by the client
    • Digital products that have been downloaded or accessed

    As a business operating in South Africa, we are committed to complying with the Consumer Protection Act (CPA). If you have any concerns or complaints, please contact us directly, and we will do our best to resolve the issue.
